Smith Could Keep Seat In House

Ousted state Representative Derrick Smith could very well keep his seat in the legislature if he's re-elected next month.  State Representative Lou Lang says the law prohibits Smith from being expelled again.

Lang is right.  Article four, Section six of the Illinois Constitution clearly says, quote "A member may be expelled only once for the same offense."  John Marshall Law School Professor Ann Lousin [[ Lou-seen ]] says the representatives could follow federal precedent and refuse to seat Smith.  Smith was expelled back in August after being arrested and charged with bribery.  Lawmakers voted to put Smith out after he refused to confirm or deny his participation in the bribery scheme.
