Defeated Congressional Candidate Suing IRS

A failed congressional candidate has sued the Internal Revenue Service, claiming its rules contributed to his loss.

Bloomington physician Dr. David Gill Doctor in November lost the 13th District race to Taylorville Republican Rodney Davis.

In his lawsuit, filed with Citizens for Responsibility and Ethics in Washington, Gill contends the tax-exempt group American Action Network spent $1.5 million in negative advertising, which contributed to his defeat. His lawsuit seeks to force the IRS to ban certain tax-exempt organizations from spending on political ads.

CREW's executive director Melanie Sloan says under federal law 501-c-4 groups like American Action Network must be operated "exclusively for social welfare purposes." But IRS regulations say such groups need only be "primarily engaged in social welfare."

IRS spokesman Michael Devine refused to comment on the lawsuit.
